TAMPA, Fla. (WFLA) – In a late Tuesday decision, a state court of appeals said it would not reconsider the April decision to not allow Joe Redner to grow his own medical marijuana.
The prominent strip-club owner was originally granted approval by Leon County Circuit Judge Karen Gievers,, who gave her ruling last year, which would have allowed Redner to grow his own medical marijuana, which, according to court documents, Redner’s doctor recommended to treat his stage 4 lung cancer.
The lawsuit was based on a 2016 state constitutional amendment that broadly legalized medical marijuana.
Since the amendment was passed by legislators. Florida has gained 78 dispensaries and 159,107 active, registered patients
Earlier this year, Florida Gov. Ron DeSantis signed a bill into law that allows medical marijuana patients to smoke the substance.
SB-182 redefined the term “medical use” to include the possession, use and administration of marijuana in a form for smoking.
“Over 70 percent of Florida voters approved medical marijuana in 2016. I thank my colleagues in the Legislature for working with me to ensure the will of the voters is upheld,” Gov. DeSantis said in a statement.
