A judge in Hillsborough County has denied a serial killer’s argument against lethal injection being used for his execution.

Bobby Joe Long, an infamous Tampa Bay murderer, was sentenced to death after being convicted of killing at least eight women in the 80s.

The past few weeks, Long’s attorneys have been in court challenging the state’s lethal injection procedure. They claimed the lethal injection would be “cruel and unusual” due Long’s diagnosed history of epilepsy, saying he could suffer a seizure after being given the cocktail of lethal drugs.

Long’s attorney’s argued that made the procedure unconstitutional.

On Monday, a judge officially denied Long’s motion. 

Long’s execution is scheduled for May 23 at 6 p.m.
