PASCO COUNTY, FL (WFLA) – A mother was arrested for child neglect in the drowning death of her 2-year-old son, according to the Pasco County Sheriff’s Office.

Deputies arrested Roxann Potts, 27, at her Hudson home early Thursday morning.

Her son, Clayton Foskey, drowned in a pond just 150 yards from his family’s home on April 27.  Searchers found him four hours later in just four feet of water.

Investigators discovered Clayton slipped out of the house through an unlocked front door. He was gone for nine minutes, according to law enforcement, before his mother noticed. Potts told investigators she had been sitting on the porch smoking a cigarette and looking at her phone.RELATED: Missing 2-year-old Pasco boy found dead

Sheriff Chris Nocco called the family home at the Verandas on Chenwood Avenue in Hudson a house of neglect.

“Tragedy could have been avoided,” Nocco said. “This is clearly a case of neglect.”

“Neighbors and family members have told us, you know, yes, they’ve seen this kid wandering around the neighborhood,” Nocco added.

According to investigators, neighbors saw Clayton wandering alone on the streets many times. They would bring him back to the house and then see him again a short time later.

On one occasion, according to an affidavit, he was found twice in one day.

Potts and her boyfriend admitted to investigators that Clayton had wandered out of the house on his own on several different occasions.RELATED: Questions remain about death of Pasco boy, 2, found in pond

“This isn’t something where somebody one time you know possibly had fallen asleep and the kid gets out. This is something that is a repeated pattern,” Sheriff Nocco said.

Neighbors agreed with the sheriff Thursday, saying the boy never had a chance.

“He wasn’t supervised,” said Randall Teague, who lives across the street. “On three or four occasions he just wasn’t supervised.”

“He should have been watched,” Teague added in disgust. “He was just at that age, he should have been watched.”

Nocco said the boy’s family had interaction with the Department of Children and Families before the drowning. In addition, Clayton’s mother, Potts, and father, Thomas Foskey, have both been arrested before.

Potts is charged with one count of child neglect and is being held at the Pasco County Jail in Land O’Lakes.

Another mother, Selina Ann Warner, 26, of New Port Richey, was also arrested Thursday and charged with child neglect and serious injury. This is an unrelated case of child drowning. It happened Apr. 21. Warner’s 2-year-old boy got out of the crib, left the house through an unlocked door and drowned in a pond.
